Terms of service

Terms of service

These Terms of Service apply to the services and products offered by Geofacta, such as the Mapviewer geocoding API service, the Mapviewer application (locator, viewer) and any related API endpoints, applications, or integrations made available by Geofacta. By using this service, you agree to these terms. If you do not agree, do not use the service.

1. Service Description

The service provides geocoding-related functionality, including but not limited to address search, place search, autocomplete, forward geocoding, and reverse geocoding. The service is provided for general informational and business use. Search results may be incomplete, inaccurate, delayed, or unavailable.

2. Permitted Use

You may use the service only in accordance with applicable law and these terms. For the purposes of these terms, any approval, permission, or authorization may be granted either directly by Geofacta or by a reseller authorized to act in the name of Geofacta. You may:

  • Use the service for internal business purposes or as part of applications approved by Geofacta;
  • Display geocoding results in your own systems or user interfaces;
  • Store limited results for a period of 30 days where reasonably necessary for application performance, auditing, or user workflows, unless Geofacta instructs otherwise.

3. Prohibited Use

You may not:

  • Use the service for unlawful, fraudulent, or misleading purposes;
  • Scrape, mirror, bulk-download, or republish the service or its datasets without permission;
  • Interfere with service availability, security, or normal operation;
  • Attempt to reverse engineer, bypass access restrictions, or gain unauthorized access to related systems;
  • Use the service in a way that creates excessive load, abusive traffic, or unreasonable automated querying;
  • Rely on the service for emergency response, life-critical, or safety-critical decisions.

4. Fair Use and Access Control

Geofacta may apply technical or administrative limits, including rate limiting, access tokens, request filtering, usage monitoring, or suspension, in order to protect the service and other users. If your use causes instability, excessive consumption, or security risk, Geofacta may restrict or terminate access without prior notice.

5. Data Sources and Third-Party Content

The geocoding service may depend on third-party software, open data, commercial data, and external infrastructure. Result quality, coverage, and permitted downstream use may therefore depend on those upstream sources. Where applicable, third-party licenses, attribution requirements, and data-source restrictions remain in force in addition to these terms. You are responsible for complying with any such requirements in your own implementation.

6. No Warranty

The service is provided on an “as is” and “as available” basis. Geofacta makes no warranty, express or implied, regarding availability, accuracy, completeness, fitness for a particular purpose, non-infringement, or uninterrupted operation. Geocoding output should be validated against your own business rules and operational requirements before being used in production workflows.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Geofacta is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, business opportunity, or goodwill arising out of or related to the use of the service. Geofacta's total liability arising from or related to the service is limited to the amount paid by you to Geofacta for the specific service giving rise to the claim during the twelve months preceding the event, or EUR 100 if no fee was paid.

8. Privacy and Logging

Geofacta may process technical logs and request metadata required for security, monitoring, troubleshooting, capacity planning, and service improvement. You must not submit personal data unless you have a valid legal basis to do so. If the service is used in a way that includes personal data, you remain responsible for meeting your own privacy, transparency, and legal obligations.

9. Intellectual Property

All rights in the service, excluding third-party components and data licensed under their own terms, remain with Geofacta or its licensors. These terms do not transfer ownership of the service or grant any right except the limited right to use it in accordance with these terms.

10. Changes and Termination

Geofacta may modify, suspend, or discontinue the service, or update these terms, at any time. Continued use of the service after updated terms become effective constitutes acceptance of the updated terms.

11. Contact

Questions regarding these terms or use of the geocoding service should be directed to Geofacta through the project or contractual contact channel applicable to your deployment.
